Biztech Lawyers Analyse GDPR Fines in Infosecurity Magazine

Biztech's Head of UK, Alison Berryman, has contributed an article to Infosecurity Magazine, discussing General Data Protection Regulation (GDPR) fines and their practical implementation.

GDPR fines: Are they working?

In her article, “GDPR Fines: Are They Working?’’, Alison discusses the various concerns about how effective a deterrent they are to wealthy tech giants.  

She explains that the GDPR has been in force since May 2018, yet there have been few fines issued by the Information Commissioner’s Office (ICO), with even the largest fines, in high-profile cases (for example, case involving British Airways, which exposed vulnerabilities and non-compliance regarding safeguarding personal data) being low in relation to the companies' annual turnover.

Alison notes that one of the most recent cases in the news, the UK's ICO announced its intention to fine TikTok £27 million for breaching UK GDPR laws but then only imposing a £12.7 million fine – a much lower than anticipated penalty and a small fraction of the company's revenue.

She adds, however, that while fines alone may not be a strong deterrent, the risk of negative publicity and loss of public trust may make companies think carefully about how they handle data.
